Terms of Service

1. Agreement to Terms

By accessing or using Smizzy ("the Service"), operated by Smizzy ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Smizzy is a creative product service for generating original artwork, previewing it on supported made-to-order products, purchasing those products, and browsing ready-made Shop designs. Available customization options are the options shown on the current product page.

3. User Accounts

To access certain features, you must create an account with a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must be at least 13 years of age to use this Service.

4. Intellectual Property & User Content

Designs generated through our AI tools are created for your personal and commercial use. However, you are solely responsible for ensuring your designs do not infringe upon the intellectual property rights of any third party.

You agree not to:

  • Upload or generate designs containing trademarked logos, copyrighted artwork, or brand assets you do not own or have license to use.
  • Create designs that impersonate existing brands, artists, or public figures.
  • Use the Service to produce content that is obscene, defamatory, or otherwise unlawful.

We reserve the right to refuse, remove, or cancel any order containing designs that we believe violate intellectual property laws or these Terms.

Smizzy is an independent retailer. A reference to a third-party company, platform, artist, athlete, league, team, or other rights holder is for identification or commentary only and does not imply affiliation, sponsorship, authorization, or endorsement.

5. Orders, Pricing & Payment

All prices are listed in USD and are subject to change without notice. Payment is processed securely through Stripe. By placing an order, you authorize us to charge the payment method provided.

Smizzy currently accepts orders for United States delivery only. Products are printed or produced after purchase. Most orders arrive within 6–10 calendar days of purchase. Some products and destinations take longer, including remote and military addresses. Holidays and carrier delays can also extend delivery times. Product-specific delivery notes apply where provided. These are estimates, not guarantees. Items with different fulfillment profiles may ship in separate packages, arrive on different days, and have separate shipping charges. 6. Refunds & Returns

Because products are made to order, we do not accept buyer-remorse, change-of-mind, or wrong-size returns or exchanges. Report a damaged, defective, misprinted, or incorrect item within 30 days of delivery. After review, you may choose a replacement or a refund for the affected item and its applicable recorded shipping allocation. A physical return is not normally required. Approved refunds are initiated within 5 business days. Your bank or card issuer may need another 5 to 10 business days to post the credit.

Whole-order cancellation is available on a best-effort basis within 20 hours of purchase. It is complete only after every fulfillment leg is stopped and the payment refund is confirmed. Partial-item cancellation is not available. See the Return & Refund Policy for the request process.

7. AI-Generated Content

Designs created by our AI are generated algorithmically and may occasionally produce unexpected or imperfect results. We do not guarantee that AI-generated content will be free from errors, artifacts, or unintended similarities to existing works. You accept full responsibility for reviewing and approving any design before purchase.

8. QR Codes & External Links

Where a supported product offers a QR-code option, the code links to a URL provided by the user. We are not responsible for the content, availability, or safety of external websites. You are responsible for ensuring that any URL you provide is appropriate and lawful. The current product page controls whether a QR-code or back-print option is available.

9. Limitation of Liability

To the maximum extent permitted by law, Smizzy and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the specific order giving rise to the claim.

10. Termination

We reserve the right to suspend or terminate your account at any time, with or without cause, including for violation of these Terms. Upon termination, your right to use the Service ceases immediately. Saved designs and drafts may be permanently deleted.

11. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms. We will make reasonable efforts to notify users of significant changes.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.
