By accessing or using Smizzy ("the Service"), operated by Smizzy ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Smizzy is an AI-powered platform that allows users to generate custom t-shirt designs featuring scannable QR codes. The Service includes design generation, previewing, purchasing, and order fulfillment through third-party printing and shipping partners.

3. User Accounts

To access certain features, you must create an account with a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must be at least 13 years of age to use this Service.

4. Intellectual Property & User Content

Designs generated through our AI tools are created for your personal and commercial use. However, you are solely responsible for ensuring your designs do not infringe upon the intellectual property rights of any third party.

You agree not to:

• Upload or generate designs containing trademarked logos, copyrighted artwork, or brand assets you do not own or have license to use.
• Create designs that impersonate existing brands, artists, or public figures.
• Use the Service to produce content that is obscene, defamatory, or otherwise unlawful.

We reserve the right to refuse, remove, or cancel any order containing designs that we believe violate intellectual property laws or these Terms.

5. Orders, Pricing & Payment

All prices are listed in USD and are subject to change without notice. Payment is processed securely through Stripe. By placing an order, you authorize us to charge the payment method provided.

Orders are fulfilled through third-party print-on-demand partners. Shipping times and availability may vary. We are not responsible for delays caused by shipping carriers.

6. Refunds & Returns

Because each product is custom-made to order, we generally do not accept returns or issue refunds. If you receive a defective or damaged product, please contact us within 14 days of delivery and we will work with you to resolve the issue, which may include a replacement or refund at our discretion.

7. AI-Generated Content

Designs created by our AI are generated algorithmically and may occasionally produce unexpected or imperfect results. We do not guarantee that AI-generated content will be free from errors, artifacts, or unintended similarities to existing works. You accept full responsibility for reviewing and approving any design before purchase.

8. QR Codes & External Links

QR codes printed on shirts link to URLs provided by the user. We are not responsible for the content, availability, or safety of any linked external websites. You are solely responsible for ensuring that the URLs you provide are appropriate and lawful.

9. Limitation of Liability

To the maximum extent permitted by law, Smizzy and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the specific order giving rise to the claim.

10. Termination

We reserve the right to suspend or terminate your account at any time, with or without cause, including for violation of these Terms. Upon termination, your right to use the Service ceases immediately. Saved designs and drafts may be permanently deleted.

11. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms. We will make reasonable efforts to notify users of significant changes.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.
